1. Scope

1.1 These General Terms and Conditions (“GTC”) of Personal Trainer Basel GmbH (“PTBS GmbH”) apply to all services provided by PTBS GmbH, including trial sessions, personal training, mental coaching, nutritional counseling, and lifestyle consulting (collectively “Training”). By booking a service, the client accepts these terms.

2. Age and Health

2.1 The client participates in training at their own risk and on a voluntary basis.

2.2 Persons under 18 may only participate with the written consent of a legal guardian.

2.3 Participation is refused in cases of contagious illness or related symptoms (e.g., flu). The client may resume training only after making a full recovery.

2.4 The client confirms that they are in good health and that no significant physical limitations or acute injuries exist from a medical standpoint.

2.5 The client further confirms that at the time of training they are sober and have not taken any medication or consciousness-altering substances that could impair their performance or safety.

2.6 The client acknowledges that physical training carries an increased risk of injury and discomfort. For individuals beginning training at an advanced age (men > 45 / women > 55), this risk is further elevated. In accordance with the recommendations of medical and sports medicine bodies, such individuals are required to independently obtain a medical examination and medical clearance certificate prior to commencing training. Failure to do so will be deemed a conscious waiver of such examination and clearance.

3. Services of PTBS GmbH

3.1 PTBS GmbH provides services in the areas of individualized training and nutrition planning, training sessions, health-promoting coaching, and professional consulting.

3.2 By purchasing a personal training subscription, the client obtains the right to use the premises, training facilities, and equipment of PTBS GmbH during personal training sessions. The offerings and opening hours of PTBS GmbH are subject to change at any time.

4. Training Location

4.1 Training sessions may take place at the PTBS GmbH studio or at another individually agreed location.

4.2 If personal training takes place at a different location, the client bears the entry fees as well as travel costs to and from that location. These costs will be invoiced to the client. Travel time is charged at CHF 2.50 per minute.

5. Data Protection

5.1 All personal data of the client, in particular health and training data, is treated confidentially and processed exclusively for the purpose of fulfilling the contract (in particular training and nutrition planning, coaching, consulting, communication, and invoicing).

5.2 Health data is considered particularly sensitive personal data. By signing the contract, the client gives their express consent to the processing of their health data.

5.3 Data will only be disclosed to third parties with the client’s express consent or on the basis of a legal obligation.

6. Initial Consultation and Health Questionnaire

6.1 PTBS GmbH offers a complimentary introductory meeting for which a period of 20 minutes is reserved. This meeting takes place in person at the PTBS GmbH studio.

6.2 If the client is interested in personal training following this meeting, an appointment for the “Personal Training Intro” will be arranged. During this appointment, the health questionnaire will be discussed in detail with support, a medical assessment will be carried out, and personal training goals and next steps will be clearly and motivationally defined.

6.3 The health questionnaire must be completed truthfully.

6.4 If multiple questions in the health questionnaire are answered with “Yes,” an elevated health risk exists. In such cases, it is recommended that the client undergo a medical evaluation before beginning training.

7. Duration and Transferability of Contracts

7.1 Personal training contracts are personal and non-transferable.

7.2 Failure to use the training services of PTBS GmbH does not entitle the client to any refund or reduction.

7.3 If the client is completely prevented from using the services for at least 4 weeks due to a medically certified reason, they may extend the subscription once, upon presentation of a medical certificate, by the documented period of incapacity — up to a maximum of 8 weeks. Refunds of amounts already paid are excluded in all cases. Transfer of remaining credit to another person is possible in exceptional cases, subject to prior agreement with PTBS GmbH.

7.4 The contract duration is specified in the individual contract. Contracts do not renew automatically.

8. Appointments

8.1 The client is required to register in advance. Training takes place only upon confirmed appointment.

8.2 Cancellations must be made at least 48 hours before the scheduled appointment, by phone or via the training and communication platform HexFit / WhatsApp.

8.3 If the client fails to cancel a booked training session in time or at all, the session cannot be rescheduled and 100% of the associated costs will be invoiced to the client.

8.4 If the client arrives up to 20 minutes late, the session will be shortened accordingly. If the client arrives more than 20 minutes late, the session is forfeited and will not be rescheduled. 100% of the cost of a forfeited session will be invoiced to the client.

8.5 In the event of a delay or cancellation caused by PTBS GmbH, the missed time or session will be made up. Refunds are excluded in all cases.

9. Communication and Availability

9.1 Communication between clients and PTBS GmbH takes place primarily via the training and communication platform HexFit / WhatsApp. All client matters — in particular cancellations, organizational inquiries, and questions regarding training, nutrition, and coaching — must be submitted exclusively through this platform.

10. Booking and Payment

10.1 Agreed training fees are to be paid by invoice prior to using the services.

10.2 If a payment deadline is not met, the client may not attend any PTBS GmbH training sessions until the outstanding payment has been received.

10.3 If an invoice is not settled within ten days, the client receives a first reminder, which must be paid within five days. If this deadline also passes, a second reminder is issued, resulting in an administrative fee of CHF 30. PTBS GmbH reserves the right to take legal action.

10.4 PTBS GmbH reserves the right to adjust prices at any time without prior notice. Already issued invoices or personal training cards are not affected by price changes.

10.5 All stated prices include statutory VAT at the applicable rate.

11. Copyright

11.1 Training plans and materials created by PTBS GmbH are protected by copyright. Reproduction or distribution without consent is not permitted.

12. Limitation of Liability

12.1 The client is obligated to follow the instructions of PTBS GmbH.

12.2 Liability of PTBS GmbH is excluded to the extent permitted by law. In particular, PTBS GmbH disclaims all liability for general damages as well as for accidents, injuries, and/or illnesses sustained by the client, unless demonstrably caused by intentional misconduct or gross negligence.

12.3 PTBS GmbH assumes no liability for the loss of valuables belonging to clients.

12.4 In the event that PTBS GmbH is found liable, such liability is limited — to the extent permitted by law — to the amount of the fee paid for the respective engagement.

12.5 The client is liable for all damage caused by them to training facilities and equipment, as well as for the loss of any borrowed items. All resulting repair or replacement costs are to be borne in full by the client.

12.5 The client is responsible for arranging their own insurance coverage.

13. Termination

13.1 Either party may terminate the contract in writing, effective the 25th of a given month, with one month’s notice.

13.2 Refunds or price reductions for personal training contracts are excluded in all cases.

14. Severability

14.1 If any individual provision of these GTC is found to be invalid, the validity of the remaining provisions shall not be affected.

15. Governing Law and Jurisdiction

15.1 All legal relationships between the client and PTBS GmbH are governed exclusively by Swiss law.

15.2 The exclusive place of jurisdiction for all proceedings is Basel-Stadt.

16. Amendments to the GTC

16.1 PTBS GmbH may amend these GTC. Any amended GTC will be communicated to the client in writing at least 30 days before taking effect.
